Terms of Service

By accessing and using Thermo Tutor ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms apply to all users of the Service, including students, educators, and visitors.

Thermo Tutor is an AI-powered educational platform that provides:

• Interactive thermodynamics practice problems
• AI-powered grading and feedback
• Progress tracking and analytics
• Educational support through follow-up questions

The Service is designed to supplement, not replace, traditional educational instruction.

Account Creation: You must provide accurate, complete information when creating your account. You are responsible for maintaining the security of your account and password.

Eligibility: You must be at least 13 years old to use this Service. Users under 18 should have parental consent.

Account Termination: You may terminate your account at any time using the account deletion feature in your Settings page. We reserve the right to suspend or terminate accounts that violate these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to other accounts or systems
• Share your account credentials with others
• Reverse engineer, decompile, or attempt to extract source code
• Use automated scripts or bots to access the Service
• Submit inappropriate, offensive, or harmful content
• Violate academic integrity policies of your institution

Learning Tool: Thermo Tutor is designed exclusively as a study and practice tool for personal learning. It should be used to understand concepts and improve your knowledge through practice.

Prohibited Academic Use: You may NOT use our Service to complete graded assignments, exams, homework, or any assessed work unless explicitly permitted by your instructor. Using our Service for academic dishonesty violates both these Terms and your institution's academic integrity policies.

Personal Understanding: All submitted academic work should represent your own understanding and effort. Our AI feedback is meant to help you learn, not to provide answers for academic submission.

Our Content: All questions, educational content, software, and platform features are owned by Thermo Tutor and protected by copyright, trademark, and other intellectual property laws. You may not redistribute, republish, or commercially use our content without written permission.

Your Content: You retain ownership of answers and responses you submit. By using the Service, you grant us a limited, non-exclusive license to use your content solely to provide the Service, generate feedback, and improve our educational platform.

License Restrictions: Your license to use our Service does not permit downloading, copying, or redistributing our educational content for use outside the platform.

Free Tier: Basic access includes 10 practice problems and 5 follow-up questions (lifetime limits).

Premium Subscription: Premium plans provide 200 monthly practice problems and 120 monthly follow-up questions for $9.90/month, billed monthly through Stripe.

Billing: Subscription fees are charged monthly in advance. You authorize us to charge your payment method for all applicable fees. Usage limits reset on your monthly billing date.

Account Deletion: You may delete your account at any time through the Settings page. Account deletion immediately cancels any active subscription with no refund for unused time. This action is permanent and cannot be undone.

Failed Payments: If payment fails, your account may be downgraded to the free tier until payment is resolved. We will attempt to collect payment and notify you of failures.

AI Accuracy: Our AI grading and feedback systems are designed to be helpful but may contain errors. AI responses should not be considered infallible. Use your judgment and consult with instructors when needed.

Service Availability: We strive for 99% uptime but cannot guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability with advance notice when possible.

Educational Supplement: The Service supplements but does not replace professional instruction, textbooks, or academic coursework.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Upon account termination or deletion through our self-service account deletion feature:

• Your access to the Service will cease immediately
• Personal learning data will be deleted immediately from active systems
• Data may persist in backup systems for up to 30 days as part of disaster recovery procedures
• Security logs may be retained as described in our Privacy Policy
• We may retain anonymized usage statistics and billing records as required by law

You may delete your account at any time through the Settings page or by contacting support for assistance.

As-Is Service: The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to merchantability or fitness for a particular purpose.

Educational Results: We do not guarantee specific educational outcomes, grade improvements, or academic success from using the Service.

Limitation of Liability: To the fullest extent permitted by law, Thermo Tutor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, use, academic performance, grades, or educational outcomes, even if advised of the possibility of such damages. In no event shall our total liability exceed $100 or the amount paid by you in the preceding 12 months, whichever is greater.

Informal Resolution: Before formal proceedings, please contact us at qwyzzee@gmail.com to resolve any disputes informally.

Binding Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance of the modified Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration will be conducted in the state or federal courts located in Florida.
